Courtroom Victories for Law Offices of Brad Jackson

Earlier this year, Mr. Jackson, Ms. Mann, and fellow firm attorney Patrick Fang won a judgment of more than $650,000 against the City of Dallas in a lawsuit over a disputed strip of property in one of the city’s most popular neighborhoods. The total amount awarded to the firm’s client exceeded $850,000 with prejudgment interest.

Law Offices of Brad Jackson Wins Judgment Against City of Dallas

Experienced business litigation attorneys Brad Jackson and Cheryl Mann, assisted by associate attorney Patrick Fang, all of Dallas’ The Law Offices of Brad Jackson, have won a judgment of more than $656,000 against the City of Dallas in a real estate dispute over a strip of valuable land along Mockingbird Lane. With the addition of prejudgment interest, the total amount due under the judgment exceeds $850,000.

Mr. Jackson and Ms. Mann successfully represented real estate developer 6101 Mockingbird, LLC in the lawsuit after the City of Dallas demanded a 10-foot strip of land as a condition of approving the owners’ request for a plat to permit the redevelopment of two adjoining lots, which the company argued was an “illegal taking.”

Mr. Jackson and Ms. Mann defeated the city’s attempts to have the case dismissed by winning a key ruling from the Fifth Court of Appeals in Dallas that cleared the way for a trial.

Judgment Includes Actual Damages, Attorneys’ Fees

The trial’s first phase was conducted in September when the court found that the city was liable to the company for taking the land. The damages phase of the trial occurred in December, with a final ruling issued in favor of Mr. Jackson’s and Ms. Mann’s client on December 23.

In the final judgment, Hon. Judge Juan Renteria of County Court at Law No. 5 ordered the City of Dallas to pay $327,603 in actual damages plus prejudgment interest of 7 percent beginning Dec. 2, 2015. The city was additionally ordered to pay $328,617.50 in attorneys’ fees and approximately $25,000 in fees for expert witnesses. If the city unsuccessfully appeals the case, it will be liable for 6101 Mockingbird’s appellate attorney fees, potentially totaling nearly $100,000.

Since last year’s list, The Law Offices of Brad Jackson won a $1 million arbitration award for a Bosque County couple whose home suffered extensive damage based on a failed roofing system.

The Law Offices of Brad Jackson would like to thank all of our friends for a memorable 2019 as we recap some of the firm’s more notable events before welcoming in the New Year.

Firm founder Brad Jackson started off the year by helping our clients defeat a $100,000 fraudulent transfer claim in a business dispute heard in Dallas district court. In an interesting twist, the case’s most important documents were written in Hebrew before being translated to English. We also had to rely on a translator because the people who unsuccessfully sued our clients spoke only Vietnamese.

Less than a week later, The Law Offices of Brad Jackson secured a summary judgment in another Dallas district court as part of a $2 million dispute over a business contract. In addition to ruling completely in our favor, the judge ordered our clients’ former business partner to pay their court costs.

We also had success in the Fifth Court of Appeals in Dallas after the court ruled in favor of our clients in a real estate dispute with the City of Dallas over $300,000 in contested property. In a completely different type of case, Brad also helped a homeowner couple win a $1 million arbitration award after the roof of their multimillion-dollar home failed and caused extensive damage.

Brad Jackson Helps Client Win $1M Arbitration Award

Brad Jackson recently helped a client win an arbitration award of nearly $1 million against Joplin, Missouri-based TAMKO Building Products Inc. after the company’s TAMKO TW Metal and Tile Underlayment roofing product failed and caused extensive damage to a newly constructed ranch house.

The award was issued on July 23 following a multiday arbitration proceeding before Chief Justice Linda B. Thomas (Ret.) of JAMS (Judicial Arbitration and Mediation Services, Inc.).

TAMKO Home Roof Fails

The case stemmed from the construction of a multimillion-dollar home and guest house in rural Bosque County. Mr. Jackson represented the individual homeowners. Dallas attorney Jeff Cook of Sullivan & Cook LLC represented the entity created to hold title to the property.

Roughly two years after construction was completed in 2015, a thick, tar-like substance began seeping out of the gutters and collecting onto the ground around the property. Eventually, the sticky tar began oozing from seams in the roof and causing extensive damage inside the structures and surrounding areas. The homeowners spent more than $1 million of their own money to help clean up the mess and repair related damage.

After it was determined that the problem stemmed from TAMKO’s faulty roof underlayment, the company acknowledged that it had falsely claimed its product could withstand temperatures of up to 250 degrees.

However, TAMKO argued, among other things, that the company’s limited warranty prevented it from being responsible for any damages in excess of the approximately $10,000 that Mr. Jackson’s clients had paid for the roofing underlayment material.

TAMKO eventually reimbursed the homeowners’ insurance company, AIG Property Casualty Inc., for the $637,425 that AIG had paid towards the repairs and damages. TAMKO then claimed that the homeowners had been fully compensated and that the company owed them no additional money.

Arbitrator Rules in Favor of Brad Jackson’s Clients

Mr. Jackson countered with claims against TAMKO for product liability, negligence, breach of implied warranties, and violation of the Deceptive Trade Practices Act (DTPA).

In the final award, Chief Justice Thomas ordered TAMKO to pay Mr. Jackson’s clients a total of $702,784 for remediation costs and $284,340 for attorneys’ fees, plus an additional $55,000 in attorneys’ fees in the event of future legal appeals. The arbitration award is in addition to the payment previously received by the homeowners from AIG for a total recovery in excess of $1.6 million.
